Term and Conditions:

  1. The Company will accommodate TCPL FT capacity turnback requests from customers, but only if it can do so in accordance with the following considerations:
    • The FT capacity to be turned back must be replaced with alternative, contracted firm transportation (primary capcity or assignment) of equivalent quality to the TCPL FT capacity;
    • The amount of turnback capacity that Enbridge otherwise may accomodate may be reduced to address the impact of stranded costs, other transitional costs or incremental gas costs resulting from the loss of STS capacity arising from any turnback request; and
    • Enbridge must act in a manner that maintains the integrity and reliability of the gas distribution system and that respects the sanctity of contracts.
  2. Requests from TCPL FT turnback must be made in writing to the attention of Enbridge's Direct Purchase group.
  3. All TCPL FT capacity turnback requests will be treated on an equitable basis.
  4. The percentage turnback of TCPL FT capacity will be applied at the Direct Purchase Agreement level.
  5. Written notice to turnback capacity must be received by the Company the earlier of:
